According to a recent Colorado State Department of Regulatory Agencies , (DORA) report, Gov. Polis signed HB21-1310 into law on July 2, 2021, which will become effective on Sept. 7, 2021. This new law defines a strong position that all home owners associations, (HOA) across the great state of Colorado must allow their residents to express themselves with appropriate flags and signage which will no doubt cause many HOA’s to amend their policy documents in order to comply with the new law. The law will of course open the door to many future legal battles where interpretations of the law between HOA’s and their residents are not aligned together.
Dora reports that the bill simplifies and broadens homeowner protections, requiring an HOA to permit the display of any flag or any sign at any time, subject only to reasonable, content-neutral limitations such as the number, size, or placement of the flags or signs, or prohibitions against commercial messages.
